1. Definitions

• "EverrCAD" or "the Service" refers to the web-based engineering design platform accessible at everrcad.com, including all features, modes, and tools.
• "User" or "You" refers to any individual or entity accessing or using the Service.
• "Content" refers to any designs, drawings, diagrams, scripts, files, or other materials created by you using EverrCAD.
• "We", "Us", or "Our" refers to EverrCAD and its operators.

2. Account Registration

• You must create an account to use EverrCAD. You agree to provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You must be at least 13 years of age to create an account.
• You are responsible for all activities that occur under your account.
• You agree to notify us immediately of any unauthorized use of your account.

3. Service Description

EverrCAD provides access to the following integrated engineering tools:

• SLD Mode: Automated Single Line Diagram generation for electrical engineering
• 2D CAD Mode: Professional 2D computer-aided design and technical drawing
• Circuit Simulation Mode: Real-time electrical circuit design and simulation
• Learn Mode: Interactive engineering education with 3D visualizations
• SimLAB Mode: Signal processing and wireless communication simulation with FLO and Python programming

4. Free Tier and Subscription Plans

4.1 Free Tier

• EverrCAD offers a free tier providing 2 hours of daily usage with access to all features and modes.
• The daily usage timer resets at midnight (Indian Standard Time, IST).
• Unused free time does not carry over to subsequent days.
• No credit card is required for the free tier.

4.2 Paid Subscription

• The monthly subscription is priced at ₹520/month (Indian Rupees).
• Subscriptions provide unlimited access to all features and modes.
• Payment is processed through Razorpay.
• Subscriptions are billed monthly and auto-renew unless cancelled.
• Prices may be updated with at least 30 days' notice to existing subscribers.

5. Intellectual Property

5.1 Your Content

• You retain full ownership of all Content you create using EverrCAD, including designs, drawings, SLD diagrams, circuit designs, and SimLAB scripts.
• By using EverrCAD, you grant us a limited license to store, display, and transmit your Content solely for the purpose of providing the Service to you.
• We do not claim any ownership rights over your Content.
• We do not use your Content for AI training, marketing, or any purpose other than providing the Service.

5.2 EverrCAD Intellectual Property

• The EverrCAD platform, including its software, design, user interface, algorithms, documentation, and branding, is owned by EverrCAD and protected by intellectual property laws.
• You may not copy, modify, distribute, reverse engineer, or decompile any part of the EverrCAD platform.
• The EverrCAD name, logo, and related marks are trademarks of EverrCAD.

6. Acceptable Use

You agree not to:

• Use EverrCAD for any illegal or unauthorized purpose
• Attempt to circumvent the free tier time limitations through technical means
• Create multiple accounts to abuse the free tier
• Interfere with or disrupt the Service or servers
• Upload malicious code, viruses, or harmful files
• Use automated scripts, bots, or scrapers to access the Service (except authorized AI crawlers for indexing)
• Resell, redistribute, or sublicense access to EverrCAD
• Share your account credentials with others
• Use the Service in a way that could damage, disable, or impair it

7. Data and Privacy

Your use of EverrCAD is also governed by our Privacy Policy, which describes how we collect, use, and protect your information.

8. Service Availability

• We strive to maintain EverrCAD's availability 24/7, but we do not guarantee uninterrupted access.
• The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
• We will make reasonable efforts to notify users of planned maintenance in advance.
• We are not liable for any loss or damage resulting from service interruptions.

9. File Formats and Compatibility

• EverrCAD uses a native .eve file format for saving projects.
• Export is available in PDF and SVG formats.
• DXF/DWG compatibility is currently in development and not guaranteed.
• We do not guarantee compatibility with third-party software.

10. Limitation of Liability

• EverrCAD is a design and educational tool. Designs created with EverrCAD should be reviewed and validated by qualified professionals before use in real-world applications.
• We are not liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the Service.
• Our total liability shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.
• Circuit simulations and engineering calculations are for educational and preliminary design purposes. They should not replace professional engineering validation.

11. Indemnification

You agree to indemnify and hold EverrCAD harmless from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Content you create or share through the Service

12. Account Termination

• You may terminate your account at any time by contacting us.
• We reserve the right to suspend or terminate accounts that violate these Terms.
• Upon termination, your right to access the Service ends immediately.
• We will retain your data for 30 days after account termination to allow for recovery, after which it will be permanently deleted.

13. Modifications to Terms

• We may update these Terms from time to time.
• Material changes will be communicated via email or a notice on the website.
• Continued use of EverrCAD after changes constitutes acceptance of the updated Terms.
• If you disagree with updated Terms, you should stop using the Service.

14. Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of EverrCAD shall be subject to the exclusive jurisdiction of the courts in India.

15. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
